    المقدمة  أنتشر الأمتياز في القرن الواحد والعشرين سريعاً ليصبح تجارة على نطاق واسع وشامل ، اذ تعتبر العناصر القانونية جزء أساسي في تحديد عملية النجاح. ان إتفاقية الأمتياز  كإتفاقية الزواج بين شخصين، صاحب الامتياز وطالب الإمتياز، حيث تبنى على المبادئ الكاثوليكية، عدم الطلاق، يقوم كلا الطرفين على احترام الواجبات التي تتعلق بهما وذلك لضمان صحة العلاقة وإستمراريتها ونجاحها.                                                                                                                     للأسف ، لا يوجد قانون في العالم العربي  اليوم  يغطي عقد الإمتياز، انما هناك قانون التمثيل التجاري الحصري ويعتبر الأقرب له، مع العلم انه غير كافٍ ويشوبه بعض الغموض، هذا بالإضافة الى أنه لا يحمى المستثمرين أو حتى أصحاب الإمتياز العالميين.                                                                                                                                     يرتكز العقد القانوني، موضوع هذه الحلقة الدراسية،  على إتفاقية امتياز ذات معايير عالمية، غير أنها أكثر مرونة، وبنودها تحمي كلا الطرفين  صاحب الإمتياز وطالب الإمتياز، كما أنها تستجيب والى حد كبير للقوانين الموضوعة في العالم العربي.
    أهداف الحلقة الدراسية:
    تساعد هذه الحلقة الدراسية المشترك على معرفة البنود القانونية، التي يجب ان تتضمن في كل اتفاقية امتياز تعقد بين كل من صاحب الإمتياز وطالب الإمتياز، بحيث يصبح المشترك  على اطلاع واسع بالمحيط والأسس المتعلقة بإتفاقية الإمتياز.

    فوائد الحلقة الدراسية:
    يتمكن اي مشترك عند نهاية هذه الحلقة الدراسية، بان يكون لديه القدرة على اعداد أي اتفاقية امتياز ، تتضمن المواد والبنود الأساسية التي يبنى عليها العقد، مدركاً تماماً الواجبات التي يجب ان يقوم بها كل من صاحب الأمتياز وطالب الإمتياز مما يؤكد على صلاحية هذه الإتفاقية لمدة عشر سنوات أو أكثر.
